HIRD Forms Repealed

Governor Signs Budget Bill Eliminating Requirement


The budget bill that Massachusetts Governor Deval Patrick signed into Law in July included the repeal of the Massachusetts HIRD Form requirement, effective July 1, 2013. Since Health Care Reform went into effect in Massachusetts, employers were required to collect an Employee HIRD (Health Insurance Responsibility Disclosure) Form from employees who declined employer-sponsored health insurance and from certain benefits ineligible employees.

The HIRD requirement will be replaced with an annual notification to employees, which the Massachusetts Health Connector will need to develop and subsequently issue related guidance.

Though technically, the HIRD Form is no longer required as of July 1, 2013, it has been suggested that employers continue to voluntarily collect HIRD Forms (as proof of offer and waiver of a section 125 plan option to employees) at least until through the end of 2013 as a precautionary measure. HIRD Forms already collected should be retained.

If you currently participate in Crosby's HIRD Form Service, we will continue to manage the process for you through the end of 2013. If you would prefer that we stop this process, please notify us at your convenience. Your client consultant will reach out to you as updates regarding the annual notification to employees from the Massachusetts Health Connector become available.

Make the Most of Your Open Enrollment Season

► Custom Communications & Promotional Materials: We can include customized communications with your enrollment packets. Promotional materials to boost participation such as FSA brochures and informational one-pagers are also available.

► Flex Debit Card: Our card adds convenience by giving participants direct access to their Medical FSA funds without having to pay out-of-pocket. Take advantage of the Flex Debit Card today.

Marketplace Availability Notifications

Crosby Can Help Make Sure Your Deadline is Met



Description: COBRA ImageDon't forget, the deadline to notify your employees about Health Insurance marketplace coverage options is October 1, 2013. The Department of Labor's  Technical Release 2013-02 provides temporary guidance for the employer notice requirement and states that current employees must receive notifications by October 1, 2013 (employees hired on or after October 1, 2013 must be notified at the time of hire). 

Crosby can assist with the distribution of this notice to current employees in order to satisfy the compliance requirements.

Transit Benefit Parity Is Still Possible

Act Introduced in Congress To Maintain $245 Limit



Description: Transit Parity Act was introduced in Congress in June that proposes making the $245 per month pre-tax Transit and Parking benefit permanent. Currently, this limit is set to expire at the end 2013, reducing it to $125 per month.
